Abstract

The present invention provides novel regulatory elements for use in plants. The present invention also provides DNA constructs containing these novel regulatory elements; transgenic cells, plants, and seeds containing these novel regulatory elements; and methods for preparing and using the same.

Claims

1 . A DNA molecule comprising a regulatory element having a DNA sequence selected from the group consisting of:
 (a) a sequence with at least 95 percent sequence identity to a DNA sequence selected from the group consisting of SEQ ID NOs: 1 and 2;   (b) a sequence selected from the group consisting of SEQ ID NOs: 1 and 2; and   (c) a fragment comprising at least 95 contiguous nucleotides of a sequence selected from the group consisting of SEQ ID NOs: 1 and 2 with promoter activity;   wherein said regulatory element is operably linked to a heterologous transcribable polynucleotide molecule.   
     
     
         2 . The DNA molecule of  claim 1 , wherein said sequence has at least 97 percent sequence identity to a DNA sequence selected from the group consisting of SEQ ID NOs: 1 and 2. 
     
     
         3 . The DNA molecule of  claim 1 , wherein said sequence has at least 99 percent sequence identity to a DNA sequence selected from the group consisting of SEQ ID NOs: 1 and 2. 
     
     
         4 . A DNA construct comprising a regulatory element having a DNA sequence selected from the group consisting of:
 (a) a sequence with at least 95 percent sequence identity to a DNA sequence selected from the group consisting of SEQ ID NOs: 1 and 2;   (b) a sequence selected from the group consisting of SEQ ID NOs: 1 and 2; and   (c) a fragment comprising at least 95 contiguous nucleotides of a sequence selected from the group consisting of SEQ ID NOs: 1 and 2 with promoter activity;   wherein said regulatory element is operably linked to a heterologous transcribable polynucleotide molecule.   
     
     
         5 . The DNA construct of  claim 4 , wherein the transcribable polynucleotide molecule is a gene of agronomic interest. 
     
     
         6 . The DNA construct of  claim 4 , wherein the transcribable polynucleotide molecule is a gene capable of providing herbicide resistance in plants. 
     
     
         7 . The DNA construct of  claim 4 , wherein the transcribable polynucleotide molecule is a gene capable of providing plant pest control in plants. 
     
     
         8 . A transgenic plant cell stably transformed with the DNA molecule of  claim 1 . 
     
     
         9 . The transgenic plant cell of  claim 8 , wherein said transgenic plant cell is a monocotyledonous plant cell. 
     
     
         10 . A transgenic plant stably transformed with the DNA molecule of  claim 1 . 
     
     
         11 . A plant part of the transgenic plant of  claim 10 , wherein the plant part comprises the DNA molecule. 
     
     
         12 . A seed of the transgenic plant of  claim 10 , wherein the seed comprises the DNA molecule.
